BY SUBMITTING A PHOTO OR VIDEO IN THIS CONTEST, THE ENTRANT HEREBY ACKNOWLEDGES AND AGREES THAT THE PHOTO OR VIDEO MAY APPEAR ON SPONSOR’S WEBSITE, SOCIAL MEDIA PLATFORMS, AND/OR BE USED IN ANY FUTURE MARKETING COMMUNICATIONS.
1. Eligibility:The Frank’s RedHot Scholarship Contest (the "Contest") is open only to legal U.S. residents of the 50 United States and District of Columbia who are at least 18 years of age (19 years of age in Alabama and Nebraska, 21 years of age in Mississippi) or older at the time of entry. McCormick & Company, Incorporated, 24 Schilling Rd Suite 1, Hunt Valley, MD 21301(the "Sponsor"), Arrowhead Promotion & Fulfillment Co., Inc, 1105 SE 8th St, Grand Rapids, MN 55744 (the "Administrator”), and any of its or their respective affiliates, parents, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, or marketing agencies, or any other company or individual involved with the design, production execution or distribution of the Contest and each of its or their employees, officers, and directors (collectively, the “Contest Entities”), and members of their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members are not eligible to enter or win. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Contest Periods: The Contest consists of the following four (4) time periods and deadlines:
a. The entry period begins on September 30th, 2024, at 12:00:01 AM Central Time (“CT”) and ends October 25, 2024, at 11:59:59 PM CT (the “Contest Entry Period”). b. The First-Round judging period will run from October 28, 2024, 12:00:01 CT and ends November 4, 2024, 11:59:59 PM CT, (“First Round Judging Period”). c. The Finalists judging period will run from November 5, 2024, 12:00:01 CT and ends November 8, 2024, 11:59:59 PM CT, (“Finalist Judging Period”). d. The popular voting period will begin on November 11, 2024, at 12:00:01 AM CT and end on November 22, 2024, 11:59:59 PM CT (“Popular Voting Period”).
a. Create a favorite tailgate meal or dish (a) that uses a Frank’s RedHot product, or (b) that would be delicious if you used a Frank’s RedHot product, and take a short video or photo (“Photo/Video”) of your meal or dish; then b. Visit www.FranksTailgateScholarship.com, complete the registration form and provide explanation (100 words or less) of why your tailgate meal or dish is delicious or would be delicious thanks to Frank’s RedHot brand products, then upload your Photo/Video. NOTE: You do NOT need to purchase any Frank’s RedHot products to enter or win; you may simply create a dish that would be delicious if you used a Frank’s RedHot product and then explain why it would be delicious if you used a Frank’s RedHot product when you upload your Photo/Video.
Please note: By entering in this Contest, you signify and agree that your entry and any other materials submitted in connection with this Contest may be posted on Sponsor’s website and/or other social media sites or applications associated with the Contest in a manner that is consistent with these Official Rules. Upon submission of entry in this Contest, you agree that Sponsor or Administrator may contact you via the email address provided at the time of entry, or by naming you on Sponsor’s social media page. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. If you are entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply.
4. Photo/Video Entry Requirements: Entrants agree to and understand that Photos/Videos will be made available to the public, including without limitation, posting on the Internet and may appear in Sponsor’s website, social media platforms, advertising and marketing materials. Whether or not Photos/Videos are published on the Internet, Sponsor does not covenant or guarantee any confidentiality with respect to any Submissions.
a. The Photo/Video must not have been submitted previously in any Contest of any kind or exhibited or displayed publicly (i.e., disclosed beyond your immediate circle of friends and family) through any means previously.
b. Each Photo/Video must be an original creation of the submitting entrant which is under no restriction, contractual or otherwise, that will prevent Sponsor's use of the Photo/Video and each Photo/Video must be free of any and all liens, encumbrances and claims of third parties. Entrant acknowledges, agrees and warrants that, nothing in the Photo/Video infringes on any copyrights, confidential information, trade secrets or trademarks belonging to any person or entity other than the Photo/Video absent a suitable license, clearance or permission agreement (proof of which is required upon submission), or violates any person's rights of privacy or publicity and that all necessary releases and permissions have been secured. Entrant agrees to indemnify and hold harmless each of the Released Parties (as defined below), from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by entrant of these Official Rules or the warranties and representations made by entrant in this paragraph. Modifying, enhancing or altering a third party's pre-existing work does not qualify as the entrant's original creation.
c. By uploading the Photo/Video, the entrant agrees, for zero compensation, to grant to Sponsor all intellectual property rights in the Photo/Video and each of its constituent parts, which rights include, without limitation, the Sponsor's right to publish, make available to the public and/or reproduce the Photo/Video through any media available at any time during, or after, the Contest Period on any websites, in any promotional materials, whether related or unrelated to the Contest, and at any other location, whether physical or online, that Sponsor, in its sole discretion, deems appropriate and necessary for the operation and promotion of this Contest. In addition, entrant warrants that any so called "moral rights'' in the Photo/Video have been waived and entrant acknowledges and agrees that Sponsor may use any ideas from any Photo/Video or other submitted materials, whether or not entrant has been awarded a prize in connection with any such Photo/Video or other materials. Entrant agrees to release, defend, indemnify and hold harmless each of the Released Parties (as defined below) from all claims, demands, and causes of action of any nature whatsoever which entrant or entrant's heirs, representatives, executors, administrators, or any other persons acting on entrant’s behalf or on behalf of entrant’s estate, have or may have by reason of: (i) Sponsor's exercise of any rights granted by entrant in this paragraph; (ii) claims based on violation of any right of publicity or rights of personality, infringement of copyright or trademark, libel, slander, defamation, invasion of privacy, loss of earnings or potential earnings in connection with Sponsor's use of the Photo/Video entry and any portion thereof, or the likeness of any natural person therein.
Submissions must not contain material that:
a. Contains or depicts someone smoking or intoxicated; b. Violates or infringes another's rights, including without limitation, privacy, publicity or intellectual property rights, or that constitutes copyright infringement; c. Contains material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; d. Contains any unacceptable clothing or adornments, or displays any commercial/corporate advertising other than that of Sponsor (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements); e. Contains indecent or unsafe behavior or situations, profanities or obscenities, including but not limited to nudity, or pornography, or is otherwise inappropriate, indecent, profane, obscene, hateful, tortuous, slanderous or libelous; f. References persons without their written permission; g. Disparages any persons or organizations; h. Includes threats to any person, place, business, or group; i. Is unlawful, in violation of or contrary to all applicable federal, state, or local laws and regulations.
6. Judging Criteria & Judging Period:
a. First Round Judging: During the First Round Judging Period, all eligible Submissions received during the Contest Entry Period will be judged by an independent judging panel using the following judging criteria and percentages: (a) Entertainment Factor (25%); (b) Adherence to the Theme (e.g.,, tailgating, food at tailgating, sports, Frank’s RedHot brand) (25%); (c) Best Representation of the Frank’s RedHot Brand (e.g., does this embody the Frank’s RedHot Brand voice, tone, and personality?) (25%); and (d) Best Visual Appeal overall (e.g., is this a fresh new idea for the Frank’s RedHot Brand?) (25%) (collectively, the “Judging Criteria”). The top twenty (20) highest scoring Submissions will be deemed First Round Finalists and move on to the Finalists Judging round. In the event of a tie, the Submission with the highest score in the Entertainment Factor criteria will be deemed the winning First Round Finalist(s) from among all tying Submissions. Sponsor reserves the right to select fewer than twenty (20) First Round Finalists in the event that there are not a sufficient amount of entries received during the Contest Entry Period. b. Finalists Judging: During the Finalist Judging Period, the twenty (20) First Round Finalists will be judged by an independent judging panel using the following judging criteria and percentages: (a) Entertainment Factor (25%); (b) Adherence to the Theme (e.g., tailgating, food at tailgating, sports, Frank’s RedHot brand) (25%); (c) Best Representation of the Frank’s RedHot Brand (e.g., does this embody the Frank’s RedHot Brand voice, tone, and personality?) (25%); and (d) Best Visual Appeal overall (e.g., is this a fresh new idea for the Frank’s RedHot Brand?) (25%) (collectively, the “Judging Criteria”). The top six (6) highest scoring Submissions will be deemed Finalists and move on to the Grand Prize -Popular Voting. In the event of a tie, the Submission with the highest score in the Entertainment Factor criteria will be deemed the winning Finalist(s) from among all tying Submissions. Sponsor reserves the right to select fewer than six (6) Finalists in the event that there are not a sufficient amount of entries received during the Contest Entry Period. Each Finalist will be notified by Sponsor or Administrator via email on or about November 11, 2024; to inform them they are moving to the next Grand Prize -Popular Voting round and to confirm eligibility. In the event Sponsor or Administrator are unable to reach the potential Finalist(s) after two (2) attempts, and/or after 48 hours from the first notification, that potential Finalist will forfeit their right to be a Finalist at Sponsor’s sole discretion, and the next highest scoring Submission will be deemed the alternate Finalist. c. Grand – Prize Popular Voting Period: The six (6) confirmed Finalist’s Submissions will each be posted on the Sponsor’s website at www.FranksTailgateScholarship.com (the “Website”) during the Popular Voting Period where members of the general public can visit the Website and vote for their favorite Photo or Video with the best public appeal through the voting mechanism on the Website. All votes must be cast by November 22, 2024, at 11:59:59 PM CT, to be counted as a vote. The highest scoring Submission that receives the most votes during the Popular Voting Period will be deemed the Grand Prize winner.
In the event of a tie, the Finalist who received the highest score in the Entertainment Factor criteria during the Finalist Judging Period will be deemed the winner from among all tying Submissions. The potential Grand Prize winner will be notified by Sponsor or Administrator via email on or about November 25, 2024. In the event Sponsor or Administrator are unable to reach the potential Grand Prize winner after two (2) attempts, and/or after 48 hours from the first notification, that potential Grand Prize winner will forfeit their right to be the Grand Prize at Sponsor’s sole discretion, and the next highest scoring Submission will be deemed the alternate Grand Prize winner. Sponsor and Administrator reserve the right to verify the potential Grand Prize winner and to confirm, at their discretion, that the potential Grand Prize winner has complied with all requirements of these Official Rules and communicates messages or images consistent with the positive image and good will of Sponsor’s brand(s).
Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to prospective voters, as determined by Sponsor in its sole discretion. Votes generated by script, macro or other automated means will be disqualified. No one may offer to sell votes (or offer to be paid, whether in currency, in kind or other form of compensation, for votes). The use of automated or third-party software or Website to participate in the Popular Voting Period is prohibited. Sponsor in its sole discretion reserves the right to disqualify any votes cast or entries associated with such votes in violation of the above restrictions. The potential Finalists will be notified by Sponsor or Administrator on or about November 11, 2024. In the event Sponsor or Administrator are unable to reach the potential Finalist after two (2) attempts, and/or after 48 hours from the first notification, that potential Finalist will forfeit their right to move on to the Grand Prize Judging Period, at Sponsor’s sole discretion, and the Finalist that received the second most votes during the Popular Voting Period will be deemed the alternate Finalist.
7. Prize and Approximate Retail Value (“ARV”) – One (1) Grand Prize will be awarded to one (1) Grand Prize winner. The Grand Prize will consist of a check for $20,000.00, made out to the Grand Prize winner. ARV: $20,000.00. All local, state and federal taxes associated with the prize are the winner’s sole responsibility.
8. Prizes are non-transferrable, and not substitutable. Sponsor may substitute the prize, or portion thereof, for one of equal or greater value at Sponsor’s sole discretion for any reason. Prize consists of only those items specifically listed as part of the Prize. Grand Prize winner is responsible for paying all applicable income taxes associated with accepting the Grand Prize. Prize winner will be required to sign an Affidavit of Eligibility/Liability and/or Publicity release and to fill out a W9 tax form providing Sponsor with their social security number or tax identification number (collectively “Prize Releases”) prior to issuance of the Grand Prize. A 1099 form will be submitted to all appropriate taxing authorities for all winners.
9. Claiming the Prize: In order to collect the Grand Prize, the potential Grand Prize winner will be required to verify their mailing address to Sponsor, and provide the Prize Release to Sponsor or Administrator, within fourteen (14) days of being notified they are a winner. Upon receipt of the executed and completed Prize Release and W9, Sponsor or Administrator will mail the Prize to the Grand Prize winner. In the event the potential winner fails to verify their address or any required documents within the timeframe provided by Sponsor, he or she will forfeit his or her right to the Grand Prize. Sponsor is not responsible for lost, late, delayed, damaged, stolen or mutilated mailing of the Grand Prize. All unclaimed or returned prizes remain the property of Sponsor.
10. Participation Conditions/Release/Consent to use Likeness: By participating, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and Administrator which are binding and final in all matters relating to this Contest; (b) release and hold harmless the Released Parties (as defined below) from and against any and all claims, expenses, and liability, including, but not limited to, negligence and damages of any kind, including, but not limited to, to persons and property, including, but not limited to, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's entry and/or participation in this Contest or any Contest-related activity, and acceptance, possession, or use or misuse of prize; (c) indemnify, defend and hold harmless the Released Parties (as defined below) from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an entrant's entry and/or participation in the Contest or any Contest-related activity and/or entrant's acceptance, possession, use or misuse of prize; and (d) allow Sponsor’s use for promotional purposes of entrant’s portrait, picture, likeness, voice, address (city/state), opinions, and name for advertising, trade and promotional purposes (including the announcement of entrant’s name) without any additional compensation, consideration, permission, or notification unless prohibited by law.
BY PARTICIPATING IN THIS CONTEST, ENTRANT AGREES THAT SPONSOR, ADMINISTRATOR, ALL OTHER SWEEPSTAKES ENTITIES, SOCIAL MEDIA PLATFORMS, AND ITS AND THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING AGENCIES, WEBSITE OR APPLICATION PROVIDERS, WEB MASTERS, ANY OTHER ENTITY OR INDIVIDUAL INVOLVED IN THE MARKETING, DESIGN, PROMOTION, DEVELOPMENT, ADMINISTRATION, OPERATION, PRODUCTION, EXECUTION, DISTRIBUTION, OR FULFILLMENT OF THE CONTEST, OR PREPARATION, MANUFACTURE, PROVISION, OR DELIVERY OF ANY PRIZE OR PRIZE COMPONENT, AND ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION INJURIES, LOSSES, OR DAMAGES TO PERSONS, INCLUDING WITHOUT LIMITATION PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY AND/OR PARTICIPATION IN THIS CONTEST OR IN ANY CONTEST-RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY.
BY SUBMITTING AN ENTRY, ENTRANT AGREES THAT SUCH ENTRY, COMMUNICATIONS OR SUBMISSIONS, CREATIVE SUGGESTIONS, IDEAS, NOTES, CONCEPTS OR OTHER MATERIALS INCLUDED IN THE SUBMISSIONS THAT ENTRANT MAY SUBMIT TO SPONSOR IN CONNECTION WITH THIS CONTEST, INCLUDING ALL RIGHTS EMBODIED THEREIN, ARE DEEMED TO BE NON-CONFIDENTIAL AND NON-PROPRIETARY AND SPONSOR SHALL HAVE NO OBLIGATION OF ANY KIND WITH RESPECT TO SUCH SUBMISSIONS. SPONSOR SHALL BE FREE TO EDIT, EXPLOIT, MODIFY, PUBLISH, REPRODUCE, USE, DISCLOSE, DISSEMINATE AND DISTRIBUTE THE SUBMISSIONS TO OTHERS WITHOUT LIMITATION IN ANY AND ALL MEDIA NOW KNOWN OR NOT CURRENTLY KNOWN, THROUGHOUT THE WORLD IN PERPETUITY FOR ANY PURPOSE WITHOUT COMPENSATION, PERMISSION OR NOTIFICATION TO ENTRANT OR ANY THIRD PARTY. ENTRANT HEREBY GRANTS TO THE SPONSOR AND ITS LEGAL REPRESENTATIVES, SUCCESSORS AND ASSIGNS, AN IRREVOCABLE AND WORLDWIDE LICENSE TO USE IN PERPETUITY THE SUBMISSIONS IN ANY FORM OR FORMAT AND TO MODIFY THE SAME, AND ACKNOWLEDGES AND AGREES THAT IF SPONSOR DOES USE THE SUBMISSIONS, ENTRANT SHALL NOT BE ENTITLED TO ANY CREDIT, CONSIDERATION, NOTICE OR PAYMENTS OF ANY KIND. ENTRANT WAIVES ANY MORAL RIGHTS HE OR SHE MAY HAVE TO THE SUBMISSIONS AND AGREES THAT IF SPONSOR ELECTS TO USE SUBMISSIONS FOR ANY PURPOSE, ALL RIGHTS UNDER COPYRIGHT OR OTHER INTELLECTUAL PROPERTY RIGHTS THAT MAY RESULT FROM THAT RELATING TO ENTRANT’S SUBMISSIONS OR FROM USE OF THE SAME BY SPONSOR SHALL BE THE SOLE PROPERTY OF SPONSOR. ENTRANT FURTHER AGREES THAT IF SPONSOR ELECTS TO USE ENTRANT’S SUBMISSIONS, ENTRANT WILL EXECUTE ANY DOCUMENTS REQUESTED BY SPONSOR REGARDING THIS ASSIGNMENT. IF ANY USE BY SPONSOR OF THE SUBMISSIONS CAUSES IT TO BE LIABLE TO ANY THIRD PARTY, ENTRANT AGREES TO INDEMNIFY SPONSOR AND ITS AGENTS, EMPLOYEES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVE AND ALL RELATED PARTIES FROM AND AGAINST ANY AND ALL DAMAGES, COSTS, JUDGMENTS AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) THAT IT INCURS AS A RESULT OF ITS USE OF THE SUBMISSIONS.
11. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, for any reason whatsoever, including, without limitation, fire, flood, natural or man-made pandemic or epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the participation process or the operation of the Contest or to be acting in violation of these Official Rules or any other Contest or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of prize described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Limitations of Liability: The Released Parties as set forth above are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited, to malfunctions, interruptions or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the participation process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of phone calls; or (5) any injury or damage, including but not limited to injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's entry and/or participation in the Contest or any Contest-related activity, or acceptance, possession, use or misuse of any Prize. WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS CONTEST, INCLUDING THE WEBSITE AND THE PRIZE, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
13. Privacy Policies and Data Collections: Information provided by you at the Website and/or on the entry form for this Contest is subject to Sponsor’s privacy policy at https://www.mccormickprivacy.com/en-us/franks. By entering this Contest, each entrant agrees that the Sponsor and/or Administrator has the right to contact the entrant by phone or email as provided on the Website or entry form to administer and fulfill this Contest.
14. Disputes/Governing Law: This Contest is governed by the laws of the State of Maryland. Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Maryland or the appropriate State Court located in Baltimore County, MD; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses (not to exceed fifty US Dollars (US$50.00)), and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor and Administrator in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Maryland.
